To avoid a legal vacuum during transition, three options exist for ensuring continuity of governance and law:
- Option 1 – Return to Pre-1979 Constitutional Framework
- Restore the 1906 Constitutional Law and legal codes of the monarchy.
- Advantage: historical legitimacy.
- Risk: may alienate groups who associate monarchy with repression.
- Option 2 – Temporary Use of Current Civil Codes
- Retain existing civil and criminal codes but strip away ideological elements.
- Advantage: minimizes disruption in courts and administration.
- Risk: legitimacy concerns, as many laws are tainted by the Islamic Republic.
- Option 3 – Hybrid Approach (Recommended)
- Preserve useful and neutral civil codes.
- Immediately annul ideological, discriminatory, and repressive laws.
- Gradually prepare the drafting of a new democratic constitution.
